Expressing happiness over the Supreme Court granting interim bail to Delhi Chief Minister Arvind Kejriwal in the ED case, the Aam Aadmi Party said the truth has won and the conspiracy of the BJP has lost.
After the Supreme Court’s decision to grant interim bail to Delhi Chief Minister Shri Arvind Kejriwal in the ED case on Friday, the Aam Aadmi Party’s National General Secretary (Organisation) and Rajya Sabha MP Dr. Sandeep Pathak, senior leader and cabinet on ministers Atishi and Saurabh Bharadwaj held a joint press conference at the party headquarters.
Dr. Sandeep Pathak said that this decision of the Supreme Court is historic for the entire country. Some decisions of the court are such that they determine the direction of the country. The court’s order has demolished the so-called liquor scam hatched by the BJP. Earlier, the order of the PMLA Special Court had also exposed the truth of this case in front of the country. Some things are written very clearly in it. First, there has been no transaction of any kind. Second, not even a single penny has been recovered from anywhere. Third, Arvind Kejriwal and Aam Aadmi Party have nothing to do with any kind of corruption. This entire case is fake. Also, the court has also significantly raised questions on the intentions of the ED, which is a big thing. When an agency deals with a party with malicious intent, it becomes a serious matter.
Dr. Sandeep Pathak said that when this issue came before the Supreme Court after the lower court, a big question was being considered whether this entire arrest was illegal? The court has studied this case and sent it to a larger bench. We believe that whatever the Supreme Court does will be good for the country and it will give direction to the country in the future. The court has granted interim bail to Arvind Kejriwal. It is worth noting that in a PMLA case, bail or interim bail is granted to someone only after hearing and seeing all the arguments and evidence.
Dr. Sandeep Pathak said that the BJP is facing defeat in every court. This case is a circus created by it, which now needs to be stopped. The time of the people of the country and Delhi should not be wasted. Every Prime Minister and his tenure has some achievement or the other. During the tenure of Narendra Modi, Amit Shah and BJP, the country has been given such a dictatorial system in which if they cannot defeat any political party head on, then they are wrongly sent to jail on false charges. This should stop. We all should do new politics so that the country can be taken forward. I request Prime Minister Modi and Amit Shah to come out of this dirty politics and do good politics.
Addressing media persons, senior AAP leader and Delhi Cabinet Minister Atishi said Arvind Kejriwal ji was granted bail by the special ED court of Rouse Avenue. Today, the Supreme Court of the country granted bail to Arvind Kejriwal ji. Whether it is the decision of the Rouse Avenue court or the decision of the Supreme Court today, it proves that the arrest of Arvind Kejriwal ji, the witch hunt of the Aam Aadmi Party leaders and ministers for the last two years, the investigation of this fake liquor scam that has been going on for the last two years is a conspiracy of the Bharatiya Janata Party only. The Bharatiya Janata Party is conspiring to stop the work of the Aam Aadmi Party, the Delhi government, the people of Delhi and hence they put the elected Chief Minister of Delhi in jail in a fake case, without any evidence.
She said while granting the bail to Arvind Kejriwal ji, the Rouse Avenue court very clearly said, not once, but repeatedly, that the Enforcement Directorate has no evidence against Arvind Kejriwal. “They also said that the ED is acting with a bias in this case. These are the words of the court; these are not our words. Today, the Supreme Court has also endorsed the decision of the Rouse Avenue court and granted bail to Arvind Kejriwal ji in the ED case,” said the senior AAP leader.
Calling Delhi Chief Minister’s arrest by CBI motivated, Atishi said but the Bharatiya Janata Party knew this, they knew that bail has been granted by the Rouse Avenue court, they knew that bail will be granted by the Supreme Court as well. “That is why they hatched another conspiracy and the day before Arvind Kejriwal’s bail case was to come up in the Supreme Court, the BJP got Arvind Kejriwal ji arrested by its another political weapon, the CBI. Why was he arrested by the CBI? They got him arrested only and only because if he gets bail in the ED case, Arvind Kejriwal ji will come out and start working for the people of Delhi at 10 times the speed. And the conspiracy of the Bharatiya Janata Party does not stop, that is why he was arrested in the CBI case,” she said.
The Delhi Cabinet Minister said today, I want to tell the Bharatiya Janata Party that one after the other, every court of this country has exposed your conspiracy. One court after another has said that there is no evidence against Arvind Kejriwal ji and today one court after another is granting bail to Arvind Kejriwal. I would like to say to the Bharatiya Janata Party that put an end to your pride, put an end to your ego. And stop plotting against other parties, against democracy, she added.
Atishi concluded: “Truth can be troubled but cannot be defeated. This bail of Arvind Kejriwal today makes it clear to the entire country that Arvind Kejriwal stood with the truth, is standing with it and will continue to do so.”
Addressing the reporters, senior AAP leader and Cabinet Minister Saurabh Bharadwaj said that the decision reserved by the double bench of Justice Sanjiv Khanna and Justice Dipankar Dutta in the Supreme Court before the vacation has been pronounced today. The Supreme Court considered that Section 19 of PMLA under which ED has arrested Arvind Kejriwal is subjective. “Bringing Section 19 into effect in this case is only the perception of ED officers. It is worth noting that the PMLA law under which the bail provisions are so strict, the rules of arrest will also be of high standard. It is not possible that you arrest someone on every small issue and then do not grant bail. Similarly, if bail is easy in any law, then arrest is also easy in it,” said the minister.
Saurabh Bharadwaj further said that the Supreme Court, while referring to the necessity of bail in its order, has clearly said that Arvind Kejriwal has already been in jail for 90 days in this case, so he should be granted interim bail. Apart from this, he also commented that there is a case against Arvind Kejriwal and in such a situation, whether he can remain the Chief Minister or not, this decision cannot be taken by any law or court. Only Arvind Kejriwal himself can take this decision. “There is no legal restriction in the court’s order, on which the BJP people were happy that Arvind Kejriwal should resign from the post of CM. He went to the High Court and the Supreme Court regarding this matter, but both said the same thing that the court cannot take any decision on whether Kejriwal will remain the Chief Minister or not,” he said.
