The Delhi BJP government’s much-touted private school fee control law has once again unravelled in court, this time before the Delhi High Court, laying bare what the Aam Aadmi Party (AAP) describes as a systematic deception of middle-class parents. On Monday, the High Court stayed the formation of fee control committees in private schools under the Act, raising serious questions over the government’s intent and credibility.
Reacting sharply, AAP Delhi State President Saurabh Bharadwaj said the court’s order has exposed the Rekha Gupta government’s close alignment with private school managements, coming just days after the government admitted before the Supreme Court that the law would not apply to increased fees in the 2025–26 academic session.
Sharing details on X, AAP Delhi State President Saurabh Bharadwaj said, “The fraud committed by the false BJP government of Delhi against private school parents was exposed in the Delhi High Court on Monday. Just last week, their manipulation was caught in the Supreme Court, where they surrendered on the increased fees for the 2025–26 academic year. Today, the committee formed by them has also been stayed by the High Court. We had already said that this law was brought only to benefit private school owners. That is why it was drafted stealthily, without any consultation and without seeking any public comments. Now the truth is coming out.”
Explaining the sequence of events in the Supreme Court, Saurabh Bharadwaj said that during last week’s hearing, the Supreme Court had questioned the Delhi government on why there was such haste in bringing this law and why it was introduced without proper deliberation. “On this, the government surrendered before the Supreme Court, and its collusion with private school owners became evident,” he said.
He further stated that the government clearly informed the court that the fee hike implemented in private schools for the 2025–2026 academic session, which began on April 1, 2025, would not be reviewed under this law and that the Act would not apply to those increased fees. “By doing this, the government effectively legitimised the arbitrary fee hikes of 20 to 80 per cent imposed by private schools and gave them a legal cover,” Saurabh Bharadwaj said.
He added that as a result, no parent or even a court would now be able to challenge those fees. “In this manner, the BJP government has handed out a jackpot to Delhi’s private schools,” Saurabh Bharadwaj said.
