- DESPITE ORDER FROM THE HIGH COURT, THE DELHI MALLS ARE STILL FLUENTLY CHARGING PARKING FEE FROM THE PUBLIC
The RTI Activist Sanjay Puri had filed a petition in the Hon’ble High Court in the favour of public, demanding for the removal of parking charges in malls, hospitals and commercial complex “, informed the AAP MLA Jarnail Singh. The high court has ordered the malls, hospitals and the commercial complex to remove the parking charges for the relief to the pockets of the public as the basements of the mall should be free of any charges and cannot be put to commercial use. The owners of the malls ,hospitals and complexes cannot charge for parking.
Every private mall of Delhi earn crores of profit by collecting parking fee from the public which proves to be the highest source of revenue not only for the owners of the malls and hospitals but also for the corrupt officials of MCD. Despite having orders from the high court and notice from MCD the malls and hospitals in Delhi are collecting the parking fee fluently.
By drawing the attention of the commissioner towards the pacific mall of west Delhi activist Sanjay Puri proved that despite the orders of court and notices from the MCD, the mall is charging parking fee very fluently and stressed on the high court’s order that states the collection of parking fee is a punishable offence. The commissioner tried a close escape by saying that he would raise this issue in the court without knowing that he has the authority to seal the places which are not following the court’s order.
After being pressurized for a long time the MCD finally wrote a letter to Sanjay Puri informing that the illegal parking charges have been removed in the pacific mall by taking an action to your complaint.
Removal of parking charges from one mall is not enough as the order should be imposed on every mall and hospitals the MCD has been warned to follow the orders of high court and relief the public of Delhi from the unnecessary parking fee as soon as possible or else the activist Sanjay Puri will be filing a contempt against the MCD, said AAP MLA Jarnail Singh
The Ambience Mall of Vasant Kunj collects parking from the public on hourly basis and same is the case with select city mall of Saket which after being ordered by the high court MCD has not stopped the illegal collections. This simply proves that the corrupt officials of MCD don’t at all want the removal of parking fee from the public places as they are the ones who are benefitting the most from the parking. The select city mall is fearlessly running a modern bazaar in its basement, which is illegal according to the high court. This is made possible with the support of MCD.

The malls of east and north Delhi have not yet followed the order of ban of parking charges and so notice have been issued to the commissioner to do the needful as soon as possible
Recovery of all the money that has been collected after the issue of order from the court from the malls and hospitals in Delhi.

हाईकोर्ट के आदेश के बाद भी पार्किंग फ्री नहीं कर रहे शॉपिंग मॉल्स और अस्पताल, तीनों निगमों में लागू होना चाहिए कोर्ट का आदेश
शुक्रवार को पार्टी कार्यालय में पत्रकारों को संबोधित करते हुए आप विधायक जरनैल सिंह ने कहा कि दिल्ली में भाजपा शासित एमसीडी और प्राइवेट मॉल्स एवं अस्पताल के मालिकों की मिलीभगत से दिल्ली में अवैध पार्किंग वसूली का गोरखधंधा चल रहा है।
आरटीआई कार्यकर्त्ता संजय पुरी द्वारा हाई कोर्ट में लगाई गई एक जनहित याचिका पर हाईकोर्ट के द्वारा दिए गए आदेश का हवाला देते हुए उन्होंने कहा कि कोर्ट के आदेश के मुताबिक दिल्ली के किसी भी प्राइवेट मॉल्स और हॉस्पिटल्स के मालिक जनता से पार्किंग चार्ज नहीं ले सकते क्योंकि उन्हें एफ़एआर में कमर्शियल घोषित नहीं किया गया है। कोर्ट ने ये साफ़ कहा है कि जो जमीन इन मॉल्स और अस्पतालों को दी गई है वो इसी शर्त पर दी गई थी कि वो जनता से पार्किंग चार्ज नहीं ले सकते।
एमसीडी द्वारा 2015-16 में जारी किए गए एक नोटिस का हवाला देते हुए उन्होंने कहा कि इस नोटिस में एमसीडी ने साफ़ तौर पर कहा है कि अगर कोई भी प्राइवेट मॉल या अस्पताल का मालिक पार्किंग चार्ज लेगा, तो हम उसके खिलाफ़ सख्त से सख्त कार्रवाई करेंगे। लेकिन बड़े अफ़सोस की बात है कि ये नोटिस सिर्फ़ एक कागज़ का टुकड़ा बनकर रह गया है। अख़बारों में इस नोटिस की खबरें छपी तो सही लेकिन ज़मीनी स्तर पर कोई कार्रवाई नहीं हुई।
उन्होंने कहा कि प्राइवेट मॉल और अस्पताल में रोज़ाना लाखों गाड़ियाँ आती हैं और पार्किंग शुल्क के रूप में करोडों रूपए इकठ्ठा होते हैं। मॉल्स और हॉस्पिटल्स के मालिकों के साथ-साथ इन रुपयों का एक हिस्सा एमसीडी के भ्रष्ट अधिकारियों और नेताओं की जेब में भी जाता है। इसीलिए हाईकोर्ट के आदेश और एमसीडी के खुद के नोटिस के बावजूद भी ये असंवैधानिक गोरखधंधा खूब फल-फूल रहा है।
हाई कोर्ट द्वारा दिए गए आदेश के आधार पर जब हमने पश्चिमी दिल्ली के निगम कमिश्नर को पश्चिमी दिल्ली में स्थित पैसिफिक मॉल में लिए जा रहे अवैध पार्किंग शुल्क की शिकायत की तो बड़े ही चौकाने वाले नतीजे सामने आए। दो दिन बाद ही एमसीडी की तरफ से हमें एक पत्र मिला, जिसमे लिखा था कि आपकी शिकायत पर कार्रवाई करते हुए पैसिफिक मॉल में पार्किंग शुल्क बंद कर दिया गया है।
हमारी शिकायत के बाद पश्चिमी दिल्ली में स्थित पैसिफिक मॉल से तो पार्किंग शुल्क हटा दिया गया, लेकिन दिल्ली में सैकड़ों ऐसे मॉल्स और हॉस्पिटल्स हैं जहाँ अब भी अवैध पार्किंग शुल्क का ये गोरखधंधा धड़ल्ले से चल रहा है।
"दिल्ली के सैकड़ों प्राइवेट मॉल्स में रोज लाखों गाड़ियां पार्क होती हैं, जिनसे करोड़ों रुपए का रेवेन्यू आता है। यह रेवेन्यू ना सिर्फ मॉल के मालिकों की जेब में जाता है साथ ही MCD के भ्रष्ट अधिकारियों की जेब में भी जाता है।" @jarnailsinghaap pic.twitter.com/tLPWln5xiK

प्रेस वार्ता के माध्यम से विधायक जरनैल सिंह ने भाजपा शासित एमसीडी के समक्ष दो मांगे रखीं
- दिल्ली में जितने भी प्राइवेट मॉल्स और हॉस्पिटल्स हैं उन सभी में जल्द से जल्द पार्किंग शुल्क हटाए जाए।
- सालों से इन प्राइवेट मॉल्स और हॉस्पिटल्स के मालिको ने पार्किंग शुल्क के रूप में दिल्ली की जनता की जेब काटकर जो पैसा इकठ्ठा किया है उसकी वसूली इन मॉल्स और हॉस्पिटल्स के मालिको से की जाए।
आरटीआई कार्यकर्ता संजय पुरी ने पत्रकारों से बात करते हुए कहा कि हमने इसे लेकर कोर्ट में जाकर लड़ाई लड़ी और कोर्ट ने पार्किंग शुल्क फ्री करने का आदेश भी पारित कर दिया, फिर एमसीडी कमिश्नर को भी इसके बारे में सूचित किया गया जिसके बाद एमसीडी ने इन सभी मॉल्स और अस्पतालों को पार्किंग फ्री करने के जानकारी दी, बावजूद इसके पार्किंग फ्री नहीं हो रही है, पैसिफिक ने तो पार्किंग फ्री कर दी है लेकिन वसंतकुंज और साकेत के मॉल्स में अभी भी घंटों के हिसाब से पार्किंग चार्ज लिया जा रहा है और ये अवैध वसूली है। ये सब एमसीडी में बैठे बीजेपी के नेताओं, निगम अफसरों और मॉल्स के मालिकों की मिलीभगत के बिना संभव नहीं हो सकता।
हमारी मांग है कि ना केवल साउथ दिल्ली नगर निगम में बल्कि उत्तरी दिल्ली और पूर्वी दिल्ली नगर निगम में भी कोर्ट का ये आदेश लागू होना चाहिए क्योंकि पूरी दिल्ली में नियम तो एक ही लागू होता है।अगर एमसीडी जल्द से जल्द हमारी इन मांगो पर कार्रवाई नहीं करती तो हम नगर निगम पर कोर्ट के फैसले की अवमानना का मुकदमा करेंगे।
