BJP falsehood on Delhi statehood exposed with documentary evidence
· AAP challenges BJP to show where and when Supreme Court said Delhi can’t be granted statehood
· AAP will not allow the BJP to escape its treachery with Delhiites
Six weeks since the Aam Aadmi Party launched its intensive campaign demanding full statehood for Delhi, a rattled, confused and desperate BJP has been resorting to daily lies in an unsuccessful attempt to divert attention fearing that it stands fully exposed before the people of Delhi and will not be able to face them during the Lok Sabha elections.
Leading the unsuccessful BJP campaign of spreading lies is its Delhi unit President Manoj Tiwari, who has been made the scapegoat before the people of Delhi.
It is not possible that a Member of Parliament does not know the process of how Delhi will attain statehood, particularly when his own party kept promising it to the people of Delhi for decades.
Latest attempt by Tiwari to spread further falsehoods on Delhi statehood was during his Twitter Chaupal, during which he said since the Supreme Court of India has stated that Delhi cannot be granted statehood therefore this matter is now over.
AAP Delhi Convenor Gopal Rai on Saturday challenged Tiwari to make public where, when and in which case the hon’ble Supreme Court of India stated what he has been claiming.
Mr Rai presented the following facts point wise before the media :
· I am saying with full responsibility that Manoj Tiwari is completely lying and misleading the people of Delhi
· I am placing before you the Hon’ble Supreme Court judgments of 4th July 2018 of the five judge Constitution Bench and 14th February 2019 of the two judges bench.
What was the issue before the Supreme Court ?
· On 23rd May 2015, Modi government brought a notification taking away the powers of Services and ACB from the elected Delhi government.
· Delhi government challenged this in Delhi High Court
· On 4th August 2016, Delhi High Court ruled in favour of the Centre, stating LG is the administrator and Services, ACB are with the Centre
· Delhi government challenged the Delhi High Court judgment in the Supreme Court
· Five judge Constitution Bench of Supreme Court in a landmark judgment on 4th July 2018 ruled that LG has no independent power and he is bound by aid and advice of the elected govt
· Other specific issues were referred to the two-judge bench, which gave a split verdict on 14th February.
Given below is the relevant portion of the 4th July 2018 Supreme Court Constitution Bench Judgment in Govt of NCT of Delhi Vs Union of India Case :
Page 229 :
“The status of NCT of Delhi is sui generis, a class apart, and the status of the Lieutenant Governor of Delhi is not that of a Governor of a
State, rather he remains an Administrator, in a limited sense, working with the designation of Lieutenant Governor.
With the insertion of Article 239AA by virtue of the Sixty ninth Amendment, the Parliament envisaged a representative form of Government for the NCT of Delhi. The said provision intends to provide for the Capital a directly elected Legislative Assembly which shall have legislative powers over matters falling within the State List and the Concurrent List, barring those excepted, and ammandate upon the Lieutenant Governor to act on the aid and advice of the Council of Ministers except when he decides to refer the matter to the President for final decision”.
The above mentioned para has been reproduced in the 14th February 2019 judgment by two judges of the Supreme Court, who have referred the matter of Services to a larger bench.
Now I have following Questions for Manoj Tiwari :
1) AAP challenges Manoj Tiwari to show which case regarding full statehood for Delhi was filed in the Supreme Court and when ?
2) Who filed the case and what was the Supreme Court judgment in the Delhi statehood case ? He should put that judgment in the public domain ?
3) Is Manoj Tiwari not even aware that full statehood for Delhi will be granted by parliament through a Constitutional amendment bill, like the one which was presented by Mr LK Advani in the parliament in August 2003, or is he deliberately misleading the people of Delhi ?
4) Manoj Tiwari says Delhi can’t be granted statehood since Arvind Kejriwal sat on a dharna outside Rail Bhawan in January 2014, then why did his party promise statehood for Delhi in March 2014, when BJP released a Delhi-specific manifesto ?
5) What is BJP’s stand on statehood for Delhi, is what Manoj Tiwari is saying is the official stand of BJP ?
AAP will not allow the BJP to escape its decades of false promises with the people of Delhi and its ultimate treachery with Delhiites.
दिल्ली को पूर्ण राज्य का दर्जा दिलाने के मुद्दे पर भाजपा का झूठ जनता के सामने हुआ बेनकाब*
*आम आदमी पार्टी भाजपा को चुनौती देती है कि साबित करें, कब और कहां सुप्रीम कोर्ट ने दिल्ली को पूर्ण राज्य का दर्जा ना देने की बात कही है :गोपाल राय*

शनिवार को एक प्रेस वार्ता को संबोधित करते हुए दिल्ली प्रदेश संयोजक एवं कैबिनेट मंत्री गोपाल राय ने कहा कि जब से आम आदमी पार्टी ने पूर्ण राज्य का आंदोलन शुरू किया है, तब से भाजपा बुरी तरह से बौखलाई हुई है, और भाजपा के नेता पूर्ण राज्य के मुद्दे को लेकर दिल्ली और देश की जनता के सामने झूठी झूठी दलीलें पेश कर रहे हैं।
भाजपा के दिल्ली प्रदेश अध्यक्ष मनोज तिवारी जी ने हाल ही में सोशल मीडिया के माध्यम से ट्विटर पर चौपाल नामक एक कार्यक्रम का आयोजन किया, और जनता के सवालों के जवाब दिए। सवालों के जवाब देते हुए उन्होंने कहा कि सुप्रीम कोर्ट ने दिल्ली को पूर्ण राज्य का दर्जा देने से मना किया है, जो कि बिल्कुल ही झूठ और बेबुनियाद है।
किसी भी पार्टी का प्रदेश अध्यक्ष जिसकी केंद्र में सरकार हो बिना तथ्यों के सुप्रीम कोर्ट के संबंध में इतना बड़ा झूठ कैसे बोल सकता है।
उन्होंने बताया कि सुप्रीम कोर्ट के 5 जजों की बेंच द्वारा 4 जुलाई 2018 को इस संबंध में फैसला सुनाया गया था, और सर्विसेज से जुड़ा मुद्दा 2 सदस्यों की बेंच को हस्तांतरित कर दिया गया था, जिस पर 14 फरवरी 2019 को अपना फैसला सुनाया था।
4 जुलाई 2018 के सुप्रीम कोर्ट के फैसले में कोर्ट ने साफ तौर पर कहा था कि उपराज्यपाल के पास कोई स्वतंत्र शक्ति नहीं है, और वह निर्वाचित सरकार की सहायता एवं सलाह से ही सभी कार्य करेंगे। इस आदेश के साथ सर्विसेज एवं एसीबी का मामला 2 सदस्यों की बेंच को हस्तांतरित कर दिया था। इन दोनों मसलों पर दो सदस्य बेंच में सुनवाई की, और सुनवाई के बाद 14 फरवरी 2019 को एक आदेश जारी करते हुए 3 सदस्य बेंच को यह मामला हस्तांतरित कर दिया गया।
सुप्रीम कोर्ट के इन दोनों ही आदेशों में सुप्रीम कोर्ट ने कहीं भी दिल्ली को पूर्ण राज्य का दर्जा ना देने की बात नहीं कही है। इन दोनों ही आदेशों के मुताबिक दिल्ली में उपराज्यपाल और दिल्ली सरकार के अधिकार क्षेत्रों को तय किया गया है, और बताया गया है कि उपराज्यपाल को दिल्ली सरकार की सहायता एवं सहमति के साथ ही काम करना होगा।
सुप्रीम कोर्ट ने मात्र एक टिप्पणी की थी, कि चूंकि दिल्ली एक केंद्र शासित प्रदेश है, इसीलिए यहां पर उप राज्यपाल के अधिकार क्षेत्र भी हैं, और चुनावी प्रक्रिया का निर्वहन भी किया जाता है।
गोपाल राय ने आम आदमी पार्टी की ओर से भाजपा एवं प्रदेश अध्यक्ष मनोज तिवारी के समक्ष पांच प्रश्न रखें जो निम्न प्रकार से हैं….
1- हमारे संज्ञान में दिल्ली को पूर्ण राज्य का दर्जा को लेकर सुप्रीम कोर्ट में कोई केस दायर नहीं हुआ है, अगर हुआ है तो मनोज तिवारी बताएं वह कौन सा केस है?
2- यह केस किसकी तरफ से दायर किया गया है उसका नाम बताएं?
3- क्या मनोज तिवारी जी नहीं जानते कि दिल्ली को पूर्ण राज्य का दर्जा संसद में बिल पास करके दिया जा सकता है, जैसा कि 2003 में एलके आडवाणी जी ने प्रस्ताव रखा था। या फिर वह जानबूझकर दिल्ली की जनता को गुमराह करने की कोशिश कर रहे हैं?
4- मनोज तिवारी कहते हैं क्योंकि केजरीवाल जनवरी 2014 में रेल भवन पर धरने पर बैठे थे, तो दिल्ली को पूर्ण राज्य का दर्जा नहीं दिया जा सकता। भाजपा एवं मनोज तिवारी बताएं कि फिर 2014 लोकसभा चुनाव में भाजपा ने किस आधार पर अपने घोषणा पत्र में दिल्ली को पूर्ण राज्य का दर्जा देने की बात कही थी?
5- दिल्ली को पूर्ण राज्य का दर्जा दिलाने पर भाजपा अपना पक्ष बताए, क्या मनोज तिवारी के बयान को भाजपा का आधिकारिक बयान समझा जाए?
*आम आदमी पार्टी करेगी अपने मेट्रो कैंपेन की शुरुआत*
एक अन्य बिंदु पर बात करते हुए गोपाल राय ने कहा कि पूर्ण राज्य आंदोलन को आगे बढ़ाते हुए आम आदमी पार्टी अपना मेट्रो कैंपेन कल शुरू करने जा रहा है। कल आम आदमी पार्टी का महिला संगठन राजीव चौक मेट्रो स्टेशन से इस कैंपेन की शुरुआत करेगा, और आगे चलकर यह कैंपेन दिल्ली के सभी मेट्रो स्टेशन तक ले जाया जाएगा।
कल दोपहर 2:00 बजे राजीव चौक मेट्रो स्टेशन पर इस कैंपेन की शुरुआत की जाएगी। जिसमें 4-4 महिलाओं की कई सारी टीमों का गठन किया गया है। राजीव चौक मेट्रो स्टेशन के कुल आठ गेट हैं, सभी गेट पर चार महिलाओं की एक एक टीम खड़ी होगी। यह टीम अरविंद केजरीवाल जी द्वारा पूर्ण राज्य पर लिखी गई चिट्ठी को मेट्रो में आने जाने वाले लोगों को वितरित करेगी, ताकि इस आंदोलन को जन-जन तक पहुंचाया जा सके।
