AAP Rajya Sabha leader Sanjay Singh’s letter to the Prime Minister demanding that judges should not be given post-retirement jobs since it compromises their judicial neutrality :

Respected Sir,
In recent years, the Indian Judiciary has been found grappling with several issues, prominent ones being its fight for autonomy and its perceived lack of credibility. Several incidents suggest that the power to announce judgements has been greatly influenced by vested interests operating outside of courts. This has raised questions in the minds of people. The fact that Judges are offered offices of profit under the Government post their retirement has seriously compromised the independence of Judiciary. Several academicians, intellectuals, media houses as well as the Indian public have been raising this issue from time to time.
We have seen how Supreme Court’s Judge Shri Adarsh Goyal had to face widespread criticism for his ruling on the SC/ST Act. The judgement mobilized the Dalit groups across the country and they took to the streets to register their protest. The government then had to bring in appropriate legislation to reverse the ruling. However, as soon as Shri Adarsh Goyal retired, he was appointed as the Chairman of the National Green Tribunal.
Former Chief Justice of India, P. Sathasivam who granted bail to the Bharatiya Janata Party President, Amit Shah was immediately appointed as Governor to the state of Kerala.
Similarly, the current Supreme Court Judge Shri A.K. Sikri who retires in first week of March this year was nominated to Commonwealth Secretariat Arbitral Tribunal. As the issue started to snowball into a controversy, the judge declined the offer. It is important to note that he had earlier accepted the same offer in December 2018.
The media has also been reporting that Shri A.K. Sikri would soon be appointed as the Lokpal. If this happens, then the credibility of the Supreme Court would be further eroded as A.K. Sikri had recently voted with the government to oust the CBI director, Alok Verma. Furthermore, several questions have been raised on A..K. Sikri’s judgement pertaining to the Delhi government Vs. Central government case related to the Services department. Making him the Lokpal would automatically indicate that he is being rewarded for his judgements.
I, therefore, request you to take cognizance of the issue raised and ensure that a neutral and unbiased individual be appointed to the important post of Lokpal. This would ensure that no questions are raised on the credibility of the Lokpal and he/ she is able to smoothly discharge the constitutional duties.

*रिटायरमेंट के बाद न्यायधीशों को न मिले लाभ का पद: संजय सिंह*
नई दिल्ली, 22 फरवरी 2019, शुक्रवार को एक प्रेस वार्ता को संबोधित करते हुए आप राज्यसभा सांसद संजय सिंह ने कहा की रिटायरमेंट के बाद उच्च न्यायालय के न्यायाधीशों को जो लाभ का पद दे दिया जाता है वह देश में एक विवाद का कारण बनता जा रहा है।
संजय सिंह ने कहा कि किसी भी न्यायाधीश द्वारा किसी केस में सरकार के पक्ष में फैसला देने के तुरंत बाद उसको लाभ का पद दे दिया जाना, देश की जनता के मन में एक शंका पैदा करता है कि कहीं यह फैसला पक्षपात पूर्ण तो नहीं था।
ऐसे कई उदाहरण हमारे देश में विधमान हैं। जैसे कि न्यायाधीश पी सदाशिव अमित शाह को जमानत देते हैं और रिटायरमेंट के बाद उन्हें केरल का राज्यपाल बना दिया जाता है। इसी प्रकार सुप्रीम कोर्ट के न्यायाधीश आदर्श गोयल ने एससी एसटी एक्ट के संबंध में एक फैसला सुनाया, जिसको लेकर पूरे देश में आंदोलन हुए, दलित समुदाय सड़कों पर उतरा और अंततः सरकार को मजबूर होकर संसद में कानून बनाकर उस फैसले को बदलना पड़ा। सरकार ने उनके रिटायरमेंट के तुरंत बाद उनको एनजीटी का चेयरमैन बना दिया।
ऐसा एक मामला हाल ही में जनता के सामने आया, न्यायाधीश ए के सीकरी का मामला। उन्होंने सीबीआई के डायरेक्टर आलोक वर्मा को हटाने के पक्ष में सरकार का समर्थन किया। उनकी रिटायरमेंट के बाद सरकार ने उन्हें लंदन में 5 साल के लिए संवैधानिक लाभ का पद दे दिया। जब मीडिया में उनकी पोस्टिंग को लेकर सवाल खड़े हुए तो जस्टिस एके सीकरी ने किसी भी तरह के पद लेने से इंकार कर दिया।
इसी प्रकार से दिल्ली सरकार बनाम केंद्र एक मामले में 5 न्यायाधीशों की खंडपीठ ने सारी सुनवाई के बाद एक बड़ा फैसला सुनाया, परंतु जस्टिस ए के सीकरी ने अपनी न्यायालय में उस पर एक और फैसला सुनाते हुए कह दिया की जमीन, पुलिस एवं लॉ एंड ऑर्डर केंद्र सरकार के अधीन रहेंगे, और बाकी अन्य मामले जो अन्य न्यायालय में लंबित हैं, उनका फैसला न्यायालय द्वारा अपने स्तर पर लिया जाएगा।
संजय सिंह ने कहा पूरी दुनिया जानती है कि आम आदमी पार्टी का उदय लोकपाल आंदोलन से हुआ। दिल्ली में एक आंदोलन हुआ, केंद्र की सरकार से देश में लोकपाल बनाने की मांग रखी, लाखों लोग सड़कों पर उतरे, परंतु न तो उस समय की कांग्रेस की केंद्र सरकार ने और न ही अबकी भाजपा की केंद्र सरकार ने लोकपाल बनाने में कोई रुचि दिखाई।
अब जब सरकार के 5 साल पूरे होने जा रहे हैं तो कई सूत्रों के माध्यम से यह सुनने में आ रहा है कि केंद्र सरकार आनन-फानन में लोकपाल का गठन करने जा रही है, और लोकपाल के पद पर जस्टिस एके सीकरी को नियुक्त किया जा रहा है। अगर ऐसा होता है तो मेरा मानना है कि लोकपाल का पद पहले दिन से ही सवालों के घेरे में आ जाएगा। इसीलिए मैंने प्रधानमंत्री जी को पत्र लिखकर यह मांग की है कि न्यायाधीशों को रिटायरमेंट के बाद कोई भी लाभ का पद नहीं दिया जाना चाहिए।
आम आदमी पार्टी की यह मांग है कि न्यायालयों की गरिमा को बनाए रखने के लिए और जनता के बीच न्यायाधीशों के मान सम्मान को बनाए रखने के लिए रिटायरमेंट के बाद किसी भी न्यायाधीश को किसी अन्य लाभ के पद पर नियुक्त नहीं किया जाना चाहिए।
